When the matter is taken up for hearing, the written instructions dated 05.11.2018 furnished by the Station House Officer, Kushaiguda Police Station are placed on record by the learned Government Pleader.
The written instructions dated 05.11.2018 read as under :- " At the outset, it is respectfully submitted that as of now, the petitioner did not approach this respondent police of Kushaiguda Police Station nor submitted or lodged any complaint/ petition with regard to his grievance and seeking protection.
It is submitted that as of now, no complaint or case whatsoever was received registered against the conducting of business in the subject premises.
I humbly submit that this respondent police did not grant any license to the petitioner to run the toddy shop in the subject premises.
I humbly submit that if necessity arises and basing on my personal enquiries with the concerned persons, certainly protection will be given.
It is submitted that this respondent did not receive any complaint with regard to the nuisance or unsocial elements created any law and order problem at the business premises of the petitioner herein.
It is always open to the petitioner to approach this respondent police of Kushaiguda and submit a representation/ petitioner narrating his grievance in seeking police protection. Certainly, this respondent will consider the request of the petitioner in consultation with the higher-ups and after causing detailed enquiry into the same with the neighbours of the subject premises of the petitioner."
By placing the above instructions on record and by leaving it open to the petitioner to file appropriate complaint before the
respondent police for taking necessary action, the writ petition is disposed of accordingly. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ________________ A.V.SESHA SAI, J Date: 19.11.2018 Prv
