THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M.GANGA RAO WAMP No.1 of 2018 in WA No.1589 of 2017 and WRIT APPEAL NO.1589 OF 2017 COMMON JUDGMENT : (Per Hon'ble Sri Justice Sanjay Kumar) This Writ Appeal arises out of the order dated 30.08.2017 passed by a learned Judge of this Court disposing of Writ Petition No.28891 of 2017. The said writ petition was filed by respondents 1 to 3 herein assailing the action of the Labour authorities in entertaining the application in S.E.No.1 of 2014 filed by Dr.Tirunagiri Sreedhar, the appellant herein, and the consequential dismissal of the appeal in S.E.A. No.3 of 2016 by the Deputy Commissioner of Labour, State of Telangana, Hyderabad. A further direction was sought to set aside the order dated 10.11.2015 passed in S.E.No.1 of 2014 by the Assistant Commissioner of Labour, Vikarabad, Ranga Reddy District.

By the order under appeal, the learned Judge set aside the impugned order and directed the Deputy Commissioner of Labour, State of Telangana, to dispose of the application filed by the writ petitioners seeking exemption from deposit of backwages within a time frame. It was left open to the third respondent in the writ petition, the appellant before us, to raise all his objections before the said authority.

It appears that during pendency of this appeal, the parties entered into a compromise. Basing thereon, WAMP No.1 of 2018 was filed by the appellant seeking leave to withdraw the writ appeal as

well as the application in S.E.No.1 of 2014 filed before the Assistant Commissioner of Labour, Vikarabad, along with consequential recovery proceedings in C.C.No.888 of 2017 on the file of the learned VIII Special Magistrate, Cyberabad at Kukatpally, in terms of the Joint Compromise Memo dated 16.04.2018 entered into by the appellant and respondents 1 to 3. The said Joint Compromise Memo is placed on record and indicates that it was signed by the appellant and respondents 1 to 3 along with their learned counsel. W.A.M.P.No.1 of 2018 is ordered taking on record the aforestated Joint Compromise Memo dated 16.04.2018, which shall be binding on the parties, and the Writ Appeal is accordingly dismissed as withdrawn.
