HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39657 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents 2 and 3 in trying to interfere with the constitution activity in H.No. 12-10-586/ 6 in Sy.No.167/ 1, admeasuring 204.33 square yards, situated at Medibavi, Seethafalmandi, Secunderabad, without following due process law, as illegal and arbitrary. 2) At the time when the matter is taken up for hearing Sri Chatla Madhu, learned Standing Counsel for the third respondent-Corporation statesthat though the petitioner has got permission to construct stilt+2, but has raised additional two floors without any permission from the authorities. That being so, the respondent-Corporation is at liberty to take steps for demolition of two floors in accordance with law. It is needless to mention that the any interference of the respondent-Corporation, even with regard to illegal structures raised by the petitioner, shall only be in accordance with law.
3) Accordingly, the Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _________________________ JUSTICE C. PRAVEEN KUMAR 02.11.2018 gkv
