HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.5406 OF 2016 ORDER:- The Notice dated 30.11.2015 issued by the 3rd respondentThe Divisional Forest Officer, Kadapa, is challenged before this Court.

Pursuant to the order dated 12.02.2015 passed by this Court in W.P.No.9826 of 2015, the petitioner made an application dated 15.03.2015 to the 3rd respondent seeking release of his seized vehicle bearing No. AP 09 CT 4235 (Toyota Innova Car), alleged to have been involved in forest offence. The 3rd respondent sought valuation of the said vehicle from the Deputy Transport Commissioner, Kadapa, who assessed the value of the vehicle at Rs.3,80,000/-. Communicating the same, the petitioner was given liberty to get the vehicle release by depositing a sum of Rs.3,80,000/- within 15 days from the date of receipt of the impugned notice.

Inasmuch as, the vehicle was seized in connection with forest offence, particularly transporting red sandal, and as by way of interim arrangement the petitioner was provided with an opportunity to get release of the vehicle on furnishing the deposit of Rs.3,80,000/-, I do not see any reason to interfere with the order.

Accordingly, the Writ Petition is dismissed. However, the dismissal of the writ petition does not disentitle the petitioner to get the vehicle released in terms of the orders of the 3rd respondent dated 30.11.2015.

Miscellaneous petitions pending consideration, if any, shall also stand closed in consequence. There shall be no order as to costs.
