This writ petition is filed for a writ of mandamus declaring the proceedings No.565 of 2015, dated 13.10.2015 and 23.11.2015 issued by the 3rd respondent, as illegal and arbitrary. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

Admittedly, the petitioner filed Crl.M.P.No.2034 of 2012 in M.C.No.9 of 2009 and the same is pending before the Additional Junior Civil Judge, Ponnur. The present writ petition is filed challenging the proceedings dated 13.10.2015 and 23.11.2015 issued by the 3rd respondent.

Once the attachment proceedings are pending before the Civil Court, it is for the petitioner to bring the fact of issuance of proceedings by the 3rd respondent, to the notice of the said court and agitate the same before the said Court for obtaining necessary orders, instead of filing the separate writ petition in respect of the same.

With the above observation, the writ petition is dismissed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _________________________ A.RAJASHEKER REDDY,J 27-09-2016 dv
