THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.37469 of 2017 ORDER:

The petitioner was initially appointed as a Watchman on 03.11.2001 and posted to Sarawari, Mahadevpur, Karimnagar District. He was promoted as Hostel Welfare Officer Grade - II on 26.06.2013 and posted to Government SCBH, Keshavapatnam, Karimnagar District. When the petitioner was placed under suspension by proceedings dated 02.11.2017, the present Writ Petition is filed.

A reading of the impugned order dated 02.11.2017 issued by the third respondent shows that it has come to his notice that the petitioner was completely irregular in the duty and careless. It was also stated that he forwarded a recorded video of filthy and vulgar words used by unknown person against the Hon'ble Chief Minister on Whatsapp Welfare Family Group on 31.10.2017 at about 8:40 pm while he was on duty. On a preliminary enquiry, the involvement of the petitioner was found to be true. In those circumstances, the petitioner was kept under suspension pending enquiry.

Since the allegations relate to discharge of duties and forwarding a message denigrating the Hon'ble Chief Minister, which prima facie shows the involvement of the petitioner, this Court is not inclined to interfere with the impugned order, but directs the third respondent to conduct the enquiry and

complete the same after giving due opportunity to the petitioner, within a period of four months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 08.11.2017 vs
