HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39711 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent-Municipality, in issuing the letter dated 25.10.2018, based on CR.No.102 and CR.No.289 dated 29.9.2018, as illegal and arbitrary.

Though various grounds are raised, learned counsel for the petitioner submits that the petitioner submitted a representation on 30.10.2018, intimating that the allegations made by the 2nd respondent are false and that the petitioner has paid the entire rent for the Shop bearing No.E6, situated at Santha Market, Yemmiganuru, Kurnool District and that no amount is due. Learned Standing Counsel for the 2nd respondent-Municipality, would submit that if the representation of the petitioner is still pending consideration, the 2nd respondent-authority, may be directed to pass appropriate orders on the same, in accordance with law. Having regard to the above, the writ petition is disposed of, at the admission stage, directing the 2nd respondent-Municipality, to deal with the representation dated 30.10.

2018, submitted by the petitioner seeking to renew the lease period of his shop, as the petitioner paid all the rents due and pass appropriate orders, in accordance with law, at the earliest. Till such time the orders are passed on the said representation, status quo, existing as on today to be maintained with regard to the possession of the subject shop. No order as to costs.
