THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.39698 OF 2018 ORDER:

This writ petition is filed seeking the following relief: "....to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not providing the Hall Ticket to the petitioner to write written test to be held on 4.11.2018 for the Post of General Duty Medical Officer in Respondents Company, vide Notification No.1 of 2018 as illegal, arbitrary, highhanded, non-application of mind, discriminatory and against to its own guidelines and consequently direct the respondents to allow the petitioner to written test to be held on 4.11.2018 by issuing Hall Ticket to the petitioner and pass such other order or orders as this Hon'ble Court may deem fit and pass such other or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents. In pursuance of the interlocutory order passed by this Court on 02.11.2018, the petitioner was permitted to appear for the written examination and accordingly the petitioner has appeared for the written examination held on 04.11.2018.

Learned counsel for the petitioner submits that the result of the petitioner be declared and if the petitioner is qualified, let her case be considered for appointment to the post of General Duty Medical Officer. Learned Standing Counsel appearing for the respondents had contended that in pursuance of the interlocutory order dated 02.11.2018, the petitioner was permitted to appear for the written examination, however her result was not declared.

This Court, having considered the submissions made by both the parties, is of the considered view that ends of justice would be met if the result of the petitioner is declared and if the petitioner is within the zone of consideration, let her case be considered for appointment to the post of General Duty Medical Officer, and if the petitioner is not qualified in the written examination, the same may be communicated to the petitioner. With the above observations, the writ petition is disposed of. No order as to costs.

Pending miscellaneous petitions, if any, shall stand closed. ____________________________ ABHINAND KUMAR SHAVILI, J Dated: 6th June, 2019 v v
