HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY C.R.P.No.6515 of 2018 Date:09.11.2018 Between:

Koyyana Srinivasa Rao, S/o Gowri Naidu .....Petitioner And:

Kagitha Venkata Rama, W/o Hanumantha Rao and another.

.....Respondents Counsel for the petitioner: Mr. M.V.Hanumantha Rao The Court made the following:

CVNR, J CRP.No.6515 of 2018 Dated:09.11.2018 ORDER:

This Civil Revision Petition is filed against order, dated 06.6.2018, in I.A.No.627 of 2014 in O.S.No.147 of 2013 on the file of the Metropolitan Sessions Judge-cum-I Additional District and Sessions Judge, Visakhapatnam.

I have heard Mr. M.V.Hanumantha Rao, the learned counsel for the petitioner, and perused the record. Respondent No.1 filed the afore-mentioned suit against respondent No.2 for cancellation of a development agreement entered into between them. The petitioner who claims to have contributed money towards the development agreement through respondent No.2-defendant filed I.A.No.627 of 2014 for his impleadment in O.S.No.147 of 2013. The lower Court has dismissed the said application. Feeling aggrieved thereby, the petitioner filed the present Civil Revision Petition. Admittedly, the petitioner is not a party to the development agreement. Even if he has made certain investments through respondent No.2-defendant, he cannot claim locus standi to come on record in the suit as, he does not have any independent right to enforce against respondent No.1plaintiff. If the petitioner has any enforceable right against respondent No.2-defendant, he is entitled to avail such legal

CVNR, J CRP.No.6515 of 2018 Dated:09.11.2018 remedies as are available to him in law. I do not, therefore, find any merit in the Civil Revision Petition and the same is, accordingly, dismissed subject to the observations made hereinbefore.

As a sequel to dismissal of the Civil Revision Petition, I.A.No.1 of 2018 filed for interim relief shall stand dismissed as infructuous. ___________________________ JUSTICE C.V.NAGARJUNA REDDY 09th November, 2018 DR
