O R D E R

Aggrieved by the inaction of the 3rd respondent - Tahsildar, in considering the application of the petitioners dated 24.08.2016 filed through Mee-seva, for conducting survey of the subject land, the present writ petition is filed. Heard the learned counsel for the petitioners. Learned Assistant Government Pleader for Revenue produced written instruction of 3rd respondent along with copy of endorsement dated 3.10.2016, whereunder, the request of the petitioners was rejected. Learned counsel submits that if the petitioners are aggrieved, they can file appeal before the Assistant Director of Survey, Visakhapatnam and that writ petition may not be entertained.

From a perusal of the endorsement dated 3.10.2016, it could be seen that 3rd respondent did not assign any reasons for rejecting the request of the petitioners for conducting survey. This amounts to violation of principles of natural justice. In view of the same, the said endorsement is set aside and the 3rd respondent is directed to reconsider the request of the petitioners and after issuing notice, take appropriate action in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Writ petition is disposed of accordingly.
