THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.36713 OF 2017 ORDER:

When the matter is taken up for hearing, learned counsel for both parties submitted that the issue raised in this writ petition is squarely covered by the judgment passed in W.A.No.72 of 2017 dated 12.04.2019 and, therefore, they contend that this writ petition can also be disposed of in terms of the said judgment.

In view of the above submissions, the writ petition is disposed of directing the respondents to issue a Circular informing all the employees, who have acquired disability during the course of their employment with the Corporation, to submit representations with regard to seeking the benefit of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (for short, 'the Act') or the benefit of the schemes floated by the Corporation itself and also the respondents shall give one month time to the employees to respond to the said Circular and, after receiving such representations, the respondents shall consider the cases of such employees for providing alternative employment in terms of Section 47 of the Act, within a period of three months thereafter, after giving an opportunity of personal hearing to each employee. No order as to costs.
