HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39841 of 2018 ORDER:
1) Heard learned counsel for the petitioners and Sri Sampath Prabhakar Reddy, learned Standing Counsel for GHMC. With their consent, the writ petition is disposed of at the admission stage. 2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent Nos.2 and 3 in interfering with the building (stilt +5 upper floors) constructed in an extent of 600 square yards at Plot No.33/MAP-II, Survey No.172, situated at Bhagyanagar colony, Kukatpally village, Balanagar mandal, Ranga Reddy District, vide permit No.52406/HO/WZ/Cir.14/2016, dated 03.08.2016, as illegal and arbitrary.
3) Learned counsel for the petitioners would submit that though he has obtained permission on 03.08.2016, and also occupancy right certificate was given on 20.09.2018, respondent Nos.2 and 3 are interfering with the construction in the land of the petitioner, without following due process of law.
4) Sri Sampath Prabhakar Reddy, learned Standing Counsel would submit that any action to be taken by the respondents shall only be in accordance with law.
5) Recording the statement of the learned Standing Counsel the writ petition is disposed of directing the authorities not to interfere with the building referred to above, without following due process of law. 6) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
