THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.11746 OF 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A.1, for grant of bail in Crime No.147 of 2018 of Kodad Rural Police Station, Suryapet District, registered for the offences punishable under Sections 406, 420 and 409 IPC.

Heard the learned counsel for the petitioner/A.1 and the learned Additional Public Prosecutor representing the respondentState and perused the record. 3.

The material placed on record reveals that the petitioner misused an amount of Rs.7,48,509/- while working as Sarpanch of Komarbanda Village. As per the allegations, there is no record to show that he spent the said amount to undertake work in Gram Panchayat limits as per the regulations. There is also no record to show that the said amount was spent for the welfare activities in the Gram Panchayat limits. The allegations are specific and grave. It cannot be held that the petitioner/A.1 is an innocent person and falsely implicated in this case. The release of petitioner would hinder the investigation. There is apprehension of tampering the record and causing interference in the investigation. The petition is devoid of merit and is liable to be dismissed.

In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
