THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37337 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in registering the FIR No.75 of 2016, as illegal and arbitrary.
Heard and perused the material available on record. The main grievance of the petitioners is that the 1st petitioner's father purchased the land in Survey No.54 of Pragallapadu Village, Peddaraveedu Mandal, Prakasam District, from the 2nd petitioner and that by playing fraud, the husband of the 4th respondent obtained pattadar pass book and after his death, the 4th respondent is making false claim to knock away the property of the 1st petitioner and that the 4th respondent made false complaint to the 3rd respondent police on 12.09.2016 and got registered a case in Crime No.75 of 2016 for the offences under Sections 447, 427, 420 IPC.
Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in FIR No.75 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 2nd November, 2016 KL
