CVNR, J & CKR, J WP.No.35641 of 2017 Order: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for a Mandamus to declare Order No.30547-30548, dated 11-04-2017, recalling final order, dated 20-10-2016, in Appeal No.E/2614/2010 on the file of the Customs, Excise and Service Tax Appellate Tribunal, Regional Bench, Hyderabad, as illegal. After arguing the case, Mr.Shaik Jeelani Basha, learned Counsel for the petitioner, submitted that his client may be permitted to withdraw the Writ Petition with liberty to file a regular appeal against the order impugned in this Writ Petition.

In view of the same, this Writ Petition is dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.

As a sequel to dismissal of the Writ Petition, WPMP.No.44292 of 2017, filed by the petitioner for interim relief, is dismissed as infructuous.
