Petition filed under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to enlarge petitioner/accused No.2 on bail in Crime No. 10 of 201 of P.S. A.C.B., Karimnagar Range on such terms and conditions. The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri M. Ram Mohan Reddy, Advocate for the Petitioners and of Sri Pappu Nageshwara Rao, Standing Counsel-cum-Special Public Prosecutor on behalf of Respondent-State, the Court made the following ORDER :- "This petition is filed under Section 439 Cr.P.C. to grant bail to the petitioner-A2 for the offences alleged under Sections 13 (1) (d) r/w 13 (2) of the Prevention of Corruption Act, 1988 and 120 (b) r/w 34 IPC. 2.
Heard learned counsel for the petitioner-A2, learned Special Public Prosecutor for ACB and perused the record. 3.
The specific allegation against the petitioner-A2 is that he is aiding his brother-in-law i.e., A1 in obtaining immovable property illegally by coercive methods and financing in the guise of chit business. The subject dispute with regard to the property covered is under a registered document No.9980 of 2012, registered on 10.09.2012, in the name of one Lalitha, who is said to be the wife of A1. The petitioner-A2 is remanded to judicial custody in this case on 12.10.2017.

Learned Special Public Prosecutor for ACB would submit that the statements of some of the witnesses under Section 164 Cr.P.C. are required to be recorded. The petitioner-A2 would influence the witnesses and hinder the investigation.
He further contended that if the petitioner-A2 is released on bail imposing some conditions i.e., directing the petitioner-A2 to stay away from Karimnagar District, that would meet the ends of justice.

Having regard to the submissions made by both sides, the petitioner-A2 can be granted bail under Section 439 Cr.P.C. on some conditions.

In the result, the Criminal Petition is allowed and the petitioner-A2 is ordered to be released on bail on his executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties each in a like sum to the satisfaction of Special Judge for SPE & ACB Cases, Karimnagar. On release, the petitioner-A2 shall not enter into Karimnagar District. The petitioner-A2 shall report before the Joint Director, ACB, State of Telangana, on every Wednesday and Saturday between 10.00 A.M. and 11.00 A.M., until further orders."
