No.2/ RCT/ACB-NZB/2017 on the file of Police Station, ACB-Nizamabad. Nizamabad District The petition coming on for hearing, upon perusing the Petition filed in support thereof and upon hearing the arguments of Sri P. LAKSHMA REDDY, for the petitioner and of leaned Public Prosecutor (TG) for the respondent-State, the Court made the following ORDER:

This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused No.1, for grant of bail in connection with Crime No.2/ RCT/ ACB-NZB/ 2017 on the file of the Police Station, ACB-Nizamabad, Nizamabad District, registered for the offences punishable under Sections 7, 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988.

2 . Heard the learned counsel for the petitioner/ accused No.1, learned Additional Public Prosecutor representing the respondentState and perused the record. 3 . The petitioner/ accused No.1 was remanded to judicial custody on 10.10.2017. It is submitted that the statement of one of the witnesses is required to be recorded under Section 164 of Cr.P.C. When the earlier bail application of the petitioner/ accused No.1 was dismissed, it was submitted that the investigation was in progress and the statements of the witnesses are required to be examined under Section 164 of Cr.P.C. Considering the gravity of the investigation, the earlier bail application of this petitioner/ accused No.1 was dismissed. It appears from the record that the all the material witnesses are examined and major part of the investigation is completed. Under these circumstances, this Court is inclined to grant bail to the petitioner/ accused No.1 under Section 439 of Cr.P.C.

Accordingly, the petitioner/ accused No.1 is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/ - (Rupees ten thousand only) with two sureties in a like sum each to the satisfaction of the learned Special Judge for SPE & ACB Cases, Karimnagar. After being released on bail, the petitioner/ accused No.1 shall report before the Station House Officer, Police Station, ACB-Nizamabad, Nizamabad District, on every Sunday between 08: 00 AM and 10: 00 AM, till filing of the charge-sheet.

5 . The Criminal Petition is, accordingly, allowed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
