HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE S.V.BHATT W. A. No.1473 OF 2018 JUDGMENT: (Per Hon'ble Sri Justice S.V.Bhatt) Heard Mr.Thimma Reddy for appellant and the learned Government Pleader for respondents.

The appellant does not challenge the findings recorded in Paragraphs 3 to 6 of the order under appeal. The appellant since is aggrieved by the contents in Paragraph 7 of the order under appeal, which read thus:

" Hence, the writ petition is dismissed."

has filed the appeal.

Mr.Thimma Reddy contends that the learned Single Judge ought to have disposed of the writ petition instead of dismissing the writ petition, for a dismissal may result in respondents understanding that this Court has granted no relief to the appellant. The learned Government Pleader, on the other hand, submits that the statement of respondents was placed on record and it hardly matters whether the writ is shown as dismissed or disposed of. We have perused the order under appeal. We are of the view that instead of getting into what ought to have been stated in Paragraph 7 and particularly keeping in view what is observed in Paragraphs 5 and 6, we dispose of the writ appeal by observing that the writ petition is disposed of.

The W.A. is disposed of accordingly. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending stand closed.
