HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.40722 OF 2018 ORDER:

Heard the learned counsel for the petitioner and the learned counsel for the respondents.

2. According to the petitioner, in an oral partition on 10.12.2006, House bearing No.12-92 was not divided and kept in the custody of the petitioner's grand mother. After the death of his grand mother, the said property reverted back to the joint family and has to be divided by all the joint family members. While so, the petitioner alleges that the 2nd respondent Municipality mutated the name of petitioner's grand mother against the said house number. Opposing the reflection of her grand mother's name in the Municipal records, the petitioner claims to have filed representation on 14.09.2017. Alleging inaction on the said representation, this writ petition is filed.

2. According to the 2nd respondent Municipality, on verification of the Municipal records, it is found that no such representation is filed before the Municipality. That being the case, it cannot be said that the 2nd respondent Municipality is not acting upon the representation of the petitioner.

3. Having regard to the claim of the petitioner and without going into the merits of the case, the writ petition is dismissed

granting liberty to the petitioner to furnish a copy of the representation stated to have been made by him on 14.09.2017 and on furnishing the copy of the said representation, the Commissioner, 2nd respondent Municipality, to take appropriate steps as warranted by law after giving opportunity to all the parties and pass appropriate orders within a period of six (6) weeks from the date of submission of the copy of the said representation.
