This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioner/accused No.3, seeking anticipatory bail in the event of his arrest in connection with PRC.No.106 of 2010 on the file of the Judicial First Class Magistrate, Sircilla, or Crime No.163 of 2010, on the file of Sircilla Police Station, Karimnagar District, registered for the offences punishable under Sections 323, 504, 506 IPC and Section 3
(1) (x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Heard the learned Counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondent- State and perused the record.
The ground that the other accused were acquitted by the Court of Sessions vide Judgment, dated 25-03-2013, in Special Sessions Case No.7 of 2011 cannot be a ground to enlarge this petitioner on bail under Section 438 Cr.P.C.
In view of the allegations levelled against the petitioner and gravity of offence, it is not a fit case to grant anticipatory bail to him. Hence, the Criminal Petition is dismissed.
