HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 9 8 8 7 of 2 0 1 8 ORDER: - Non-payment of remuneration to the petitioner herein, who appeared as a Special Public Prosecutor in S.C.No.42/ 2008, despite submitting a representation to the 2nd respondent on 14.02.2018, is the grievance of the petitioner in the present Writ Petition.
According to the petitioner, he is a practicing Advocate in Nalgonda Bar Association. By way of G.O.Rt.No.490, LAW (LA&J-HOME-COURTS.A2) DDEPARTMENT, dated 29.03.2014, the 1st respondent-State Government appointed the petitioner herein as a Special Public Prosecutor to conduct prosecution in S.C.No.42/ 2008 on the file of the Special Court for Trial of Offences under SCs/ STs (POA) Act, 1989.
The said S.C.No.42/ 2008 ended in acquittal by way of judgment, dated 31.01.2017. The complaint of the writ petitioner in the present Writ Petition is though the Sessions Court disposed of S.C.No.42/ 2008 as long back as on 31.01.2017, the remuneration due to the petitioner herein has not been paid by the respondents so far. In fact, according to the petitioner, on 14.02.2018, he made a representation to the 2nd respondent requesting to arrange payment of remuneration/ fee but no action has been taken so far despite lapse of considerable time. Having regard to the submissions made by the learned Counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition,
with a direction to the 2nd respondent to verify the representation, dated 14.02.2018, said to have been made by the petitioner herein and take appropriate action/ pass appropriate orders, as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order.
