THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.18048 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the respondents in not appointing the petitioner as Junior Assistant in terms of G.O.Ms.No.612 dated 30.10.1991 as arbitrary ad illegal. A consequential direction is also sought to give appointment to the petitioner on compassionate grounds.

None appeared for the petitioner.

It has been contended by the petitioner that his father was working as Pump Driver in Osmania University and while discharging his duties, he expired on 21.2.1992. It has been further contended that he had submitted an application on 15.7.1992 requesting the respondents to consider his case for appointment on compassionate grounds in terms of G.O.Ms.No.612 dated 30.10.1991, but the respondents have not passed any orders.

This Court having considered the submissions made is of the view that this writ petition can be disposed of directing the respondents to consider the case of the petitioner for

compassionate appointment in terms of G.O.Ms.No.612 dated 30.10.1991.

Accordingly, the Writ Petition is disposed of directing the respondents to consider the case of the petitioner for compassionate appointment in terms of G.O.Ms.No.612 dated 30.10.1991 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.

Learned counsel for the petitioner submits that the petitioner retired from service and the cause in the writ petition does not survive.

Accordingly, the Writ Petition is dismissed as infructuous. No order as to costs.
