This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner-A6 for the offences alleged under Sections 420, 468 and 471 IPC.

Heard learned counsel for the petitioner-A6, learned Additional Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner-A6 would submit that the petitioner-A6 is falsely implicated in this case. A2 is the brother-in-law of the petitioner-A6. A2 made a false confession that the petitioner-A6 provided false Civil Diploma Certificates to secure jobs in Housing Corporation. The alleged confession was said to have been made as the wife of A2 got registered a case against A2 under Section 498-A IPC. The allegations are totally false. The petitioner-A6 has no connection with the alleged procurement of false diploma certificates and ultimately, prayed to allow the application.

As per the record, the allegation against the petitioner-A6 is that he has fabricated false Civil Diploma certificates and gave it to A2 and others. On the basis of those certificates, they secured employment in Housing Corporation and in other departments also. The matter requires thorough investigation. The source of supply of false certificates in this case is from petitioner-A6. The allegations are serious in nature. The release of the petitioner-A6 under Section 438 Cr.P.C. would hinder the investigation and the petitioner-A6 would tamper with the

material evidence and there is possibility of causing disappearance of evidence.

Under these circumstances, it is not a fit case to grant bail to the petitioner-A6 under Section 438 Cr.P.C. 6.
