Abdul Lateef Shaik , Shaik Lateef , Danish, Hyd v. The State Of Ts., Rep. By P.P. And Another
SMT JUSTICE T.RAJANI CRIMINAL PETITON No.11258 OF 2017 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A3, in Crime No.17 of 2016 on the file of CID Police Station, Hyderabad. The offences alleged are under Sections 420, 463, 406 r/w 34 IPC.
2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
As per the case of the prosecution, the accused/ A1 to A4 cheated several people in the pretext of multiplying their money through rice pulling. The counsel for the petitioner submits that the allegation against this petitioner/A3 is only that some money was given to this petitioner, while specific amount was stated as having been given to the other accused. But that shall not entitle the petitioner for anticipatory bail, when, prima facie, it is evident that he also had a role in the crime. 4.
Hence, in view of the above circumstances, this court opines that this is not a fit case for granting anticipatory bail. 5.
Accordingly, the Criminal Petition is dismissed. However, the petitioner can surrender himself before the regular court for obtaining regular bail, like the other accused. 6.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
