HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.10366 OF 2017 ORDER:

Heard Sri S. Surender Reddy, learned counsel for the petitioner. The learned counsel draws attention to the order, dated 29.08.2017, passed in Criminal Petition No.7726 of 2017 concerning accused No.22 in the very same crime, requesting to pass similar order, whereby and whereunder, the learned single Judge of this Court has directed the Station House Officer, to follow the procedure prescribed under Section 41A of the Code of Criminal Procedure, 1973 (for short 'the Code') and the guidelines and the expression of the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1. The learned counsel is justified in seeking such a relief. Therefore, the present Criminal Petition is disposed of, directing the Station House Officer, Mattampally Police Station, Suryapet District, Telangana State in Crime No.171 of 2017, to follow the procedure under Section 41A of the Code and adhere strictly to the guidelines laid down by the Hon'ble Supreme Court in Arnesh Kumar's Case in so far as the petitioner - Accused No.13 is concerned.
