THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7546 of 2016 ORDER:

This criminal petition, under Section 438 of the Code of Criminal Procedure, is filed by the petitioner/accused seeking to grant bail in Crime No.108 of 2016, on the file of Subedari Police Station, Warangal District, registered for the offences punishable under Sections 385, 506 IPC and Section 3(2)(v)(a) of the SCs & STs (POA) Amendment Act, 2015.

Heard and perused the material available on record.

The allegation against the petitioner is that on 07.04.2016 at about 17.30 hours, the accused made a call to the mobile of the de facto complainant and blackmailed her that they are going to publish adverse news against her and asked her to meet him immediately and when she met the accused on the road, the accused sat in the car and attempted to commit extortion by demanding Rs.1,00,000/- from her and abused her in the name of caste and threatened with dire consequences. The learned Additional Public Prosecutor opposed this petition and submitted that in view of the nature of the offence, this petition for anticipatory bail is not maintainable.

Considering the facts and circumstances of the case and the submissions made by the learned Additional Public Prosecutor and in view of the nature of the offence, this Court is of the view that this petition is not maintainable.

Accordingly, the Criminal Petition is dismissed.
