THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.10291 OF 2017 ORDER:
This petition is filed under Section 482 of the Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in Crime No.267 of 2017 of P.S. Subedari, Warangal District, for the offences punishable under Sections 420, 504 and 506 of the Indian Penal Code and Section 156(3) Cr.P.C. The de facto complainant filed a private complaint against the petitioners under Section 200 Cr.P.C. for the offences punishable under Sections 406, 417, 504 and 506 IPC and Section 4 of the Dowry Prohibition Act. Learned IV Additional Judicial First Class Magistrate, Warangal, referred the complaint to the police under Section 156(3) Cr.P.C. After investigation, a charge sheet was filed on 05.10.2017, which is not yet registered as Calendar Case. A copy of the letter dated 26.10.
2017 to that effect addressed to the learned Public Prosecutor for the State of Telangana by the SubInspector of Police, Subedari P.S., Warangal District is placed on record. The said letter clearly discloses that investigation is completed and charge sheet was filed on 05.10.2017. Therefore, the present petition to quash the FIR becomes infructuous. However, liberty is given to the petitioner to challenge the proceedings in the charge sheet.
Accordingly, the Criminal Petition is dismissed as infructuous. Miscellaneous petitions, if any, pending shall stand dismissed.
