HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39850 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent-Municipal Corporation, in not granting the permission for construction of a building in the premises bearing No.8-2-166/2, Kattarampur, Karimnagar District, pursuant to the application made by the petitioner, through online vide bearing BA No.3011/W27/2018/3384 dated 30.04.2018, as illegal and arbitrary. When the matter is taken up for hearing, learned Standing Counsel for the respondents 2 and 3, would submit that the request of the petitioner could not be considered in view of certain shortfalls in the application made by him seeking permission for construction of a building in the subject premises. It appears that subsequent to filing of the present writ petition, petitioner herein has resubmitted the application fulfilling the requirements as required by the respondents 2 and 3. If that being so, the writ petition can be disposed of at the stage of admission, directing the respondents 2 and 3 to dispose of the application of the petitioner, in accordance with law.

Having regard to the above, the writ petition is disposed of, at the admission stage, directing the respondents 2 and 3, to deal with the application made by the petitioner through online vide bearing BA No.3011/W27/2018/3384, dated 30.04.2018, seeking to grant permission for construction of a building in the subject premises and pass appropriate orders, in accordance with law, as early as possible, preferably within a period of four to six weeks, from the date of receipt of copy of this order. No order as to costs.
