The Hon'ble Dr.Justice Shameem Akther Criminal Petition No.10748 of 2017 Order:
This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioner/accused, seeking anticipatory bail in the event of his arrest in connection with Crime No.195 of 2017, on the file of Korukonda Police Station, East Godavari District, registered for the offences punishable under Sections 498-A, 323 and 506 IPC.
Heard the learned Counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondentState and perused the record. The learned Counsel for the petitioner would submit that the petitioner is an innocent person; that he has been falsely implicated in this case; and that no incident, as reported by the defacto complainant, had, in fact, taken place.
The learned Public Prosecutor opposed for grant of anticipatory bail to the petitioner.
As per the material placed on record, on 19-08-2017, at 11.00 hours, when the defacto-complainant was in her house,
Dr.SA, J Crl.P.No.10748 of 2017 Dt: 14-11-2017 the petitioner beat her and threatened to kill her. It is also brought to the notice of this Court that the defactocomplainant is the wife of the petitioner and that they are living separately.
There are specific overt acts against the petitioner as evident from the report lodged by the defacto-complainant. The petitioner is not allowing his wife to live peacefully, even after separation. The victim was shifted to GG Hospital after beatings. There is MLC intimation. There are continuous threats to victim. In these circumstances, it is not appropriate to grant anticipatory bail to him. Hence, the Criminal Petition is dismissed.
