The Hon'ble Dr.Justice Shameem Akther Criminal Petition No.10700 of 2017 Order:
This Criminal Petition, under Section 438 of Cr.P.C., is filed by the petitioner/accused No.3, seeking anticipatory bail in the event of his arrest in connection with Crime No.82 of 2017, on the file of the Station House Officer, Devarakadra Police Station, Mahaboobnagar District, registered for the offences punishable under Sections 307, 201, 120-B r/w 34 IPC.
Heard the learned Counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondentState and perused the record. The learned Counsel for the petitioner would submit that the petitioner is an innocent person; that there is no motive to cause the death of the deceased and that he is falsely implicated in this case. The learned Counsel further submitted that the rest of the accused were already arrested and remanded to judicial custody and prayed to allow this Petition.
Dr.SA, J Crl.P.No.10700 of 2017 Dt: 13-11-2017 The material on record reveals that on 31-08-2017, when defacto-complainant was returning home on his bullet Motor Cycle bearing registration No.TS 06 EA 3888, the petitioner/accused No.3 along with 2 other persons chased the jeep and dashed the same due to which, the defactocomplainant suffered grievous injuries all over the body. The motive for commission of offence is that the defactocomplainant developed politically and by doing business also. The petitioner and accused Nos.1 and 2 developed eyesore against the defacto-complainant and in order to eliminate the defacto-complainant, they have indulged in such an activity. The names of the petitioner, accused Nos.2 and 3 are mentioned in the First Information Report (FIR).
The FIR was lodged with the Police immediately after the commission of the alleged offence. There are specific overt acts against the petitioner and the motive behind commission of offence is also found in the FIR. Release of the other accused in the said Crime is not a ground to allow this Petition. Hence, this Criminal Petition is dismissed.
