Heard Sri G. Rama Sharma, learned counsel for the petitioners, and the learned Assistant Public Prosecutor for the respondents. In these two petitions, the petitioners are two different complainants, but respondent Nos.2 to 4, who are arraigned as Accused Nos.1 to 3, are common. In fact, the prosecution moved Crl.M.P.No.3584 of 2017 in C.C.No.353 of 2008 and also Crl.M.P.No.3586 of 2017 in C.C.No.245 of 2008 on the file of the XIV Additional Chief Metropolitan Magistrate, Hyderabad, under Section 311 of the Code of Criminal Procedure, requesting to recall PWs.4 and 3, respectively, for the purpose of marking the document bearing No.3027/Val/03, dated 09.06.2003.
Learned counsel for the petitioners would submit that, in fact, the petitions under Section 311 of the Code were filed before the Court below to recall the witnesses for the purpose of marking the document bearing No.3027/Val/03, dated 09.06.2003, but, some how, in the present criminal petitions, the description of the document is wrongly mentioned as 'CC/401/2008, dated 02.02.2008'. Therefore, he seeks permission to withdraw the present petitions stating that fresh petitions with proper particulars would be filed.
Permission is accorded.
Accordingly, both these Criminal Petitions are dismissed as withdrawn.
Miscellaneous applications, if any, pending in these Criminal Petitions stand closed.
