Heard Mr.Sai Krishna Mohan Rao for petitioner and the learned Government Pleader for Revenue.
The petitioner prays for Mandamus declaring the action of 3rd respondent in interfering and threatening to dispossess the petitioner from Plot Nos.7 and 8 of Nizampet Village, Qutbullapur Mandal, Ranga Reddy District without recourse to law, as illegal, arbitrary and unconstitutional.
The petitioner prays for consequential direction against the respondents not to interfere with petitioner's possession of subject matter of writ petition. On 01.06.2016, this Court granted status quo obtaining as on that date and the interim order has been extended from time to time and is subsisting.
The respondents in spite of receipt of notice in the writ petition and also the order copy have not chosen to file counter affidavit or send instructions to their Advocate. The petitioner in support of her right and possession relies upon registered sale deeds dated 27.11.2015 executed in her favour by one Uma and V.Baby and the building permission granted by Gram Panchayat, Nizampet Village. The petitioner claims to be in actual and physical possession of the property purchased through the sale deeds referred to above. The grievance of the petitioner is limited to the extent that the
possession and enjoyment of petitioner is not disturbed even if circumstances warrant, except in accordance with law. Having regard to the fact that instructions are not forthcoming till date, the counsel consent to disposing of the writ petition by this order: The writ petition is disposed of by directing respondents not to interfere with petitioner's possession of Plot Nos. 7 and 8 of Nizampet Village or the adjoining land, except in accordance with law. No order as to costs.
