SEETHARAMA MURTI WRI T PETI TI ON No.29152 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the applicant in O.A.No.1476 of 2016 before the Andhra Pradesh Administrative Tribunal, Hyderabad. By order dated 19.04.2016, the Tribunal disposed of the said O.A. directing the Inspector General of Police, Andhra Region, Visakhapatnam, to consider and dispose of the appeal filed by the applicant against the punishment order issued by the Superintendent of Police, Rajahmundry Urban District, on merits and in accordance with law within a period of two months from the date of receipt of a copy of the said order.

The petitioner's grievance was that his case was not being considered for promotion to the post of Deputy Superintendent of Police, owing to the disciplinary proceedings.

It appears that the appeal of the petitioner/applicant was rejected by the Inspector General of Police, North Coastal Zone, Hyderabad, on 14.03.2016. However, the currency of punishment imposed upon the petitioner/applicant worked itself out by efflux of time. Learned Government Pleader appearing for the State was therefore asked to get instructions as to whether there is any impediment to consideration of the petitioner's candidature for promotion. Today, the learned Government Pleader produced written instructions dated 03.09.2016 furnished to his office by the Director General of Police, Andhra Pradesh, Hyderabad, wherein the Director General stated that the punishment imposed upon the petitioner/applicant was for a period of one year and the said period has expired. The Director General further stated

that the case of the petitioner/applicant for promotion to the post of Deputy Superintendent of Police would be considered in the next Departmental Promotion Committee as per his suitability, eligibility and the rules in vogue.

In the light of the afore-stated commitment given by the Director General of Police, Andhra Pradesh, Hyderabad, we see no reason to entertain this writ petition or adjudicate the same on merits. The writ petition is accordingly disposed of taking on record the commitment given by the Director General of Police, Andhra Pradesh, Hyderabad.
