HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.10659 OF 2017 ORDER:

This Criminal Petition is filed by the petitioner under Section 438 of Cr.P.C. for grant of anticipatory bail in Crime No.271 of 2017 of Alze Police Station, Jogulamba, Gadwal District, registered for the offences punishable under Section 304-A I.P.C.

Heard the learned counsel for the petitioner, and the learned Additional Public Prosecutor appearing for the respondent-State, apart from perusing the material available on record. 3.

The learned counsel for the petitioner would submit that there is apprehension of arrest of the petitioner in this case for the offence under Section 34 of the A.P. Excise Act.

The material on record reveals that the son of the de facto complainant having consumed toddy while proceeding on a motorcycle, fell down, suffered injuries and died. Consequently, this crime is registered for the offence under Section 304-A I.P.C. and under investigation. The main accused was enlarged on bail by the concerned Station House Officer.

Learned Additional Public Prosecutor has submitted that as on today, this petitioner is not required in this case. 6.

Under the above circumstances, it can be safely concluded that there is no apprehension of arrest of the petitioner for a non-bailable offence. Therefore, this Criminal Petition is devoid of merits and, accordingly, it is dismissed. As a sequel, miscellaneous petitions, if any, pending in this Criminal Petition shall also stand dismissed. _________________________ Dr. SHAMEEM AKTHER, J Date: 20-11-2017.
