Crl.P.M.P.Nos.11565 and 11566 of 2017 These miscellaneous petitions are filed under Section 482 read with 320 Criminal Procedure Code (for short "Cr.P.C.") seeking leave to compromise the case and compound the offences punishable under Sections 498-A, 323 and 506 read with 34 of Indian Penal Code (for short "I.P.C.") and under Sections 4 and 6 of Dowry Prohibition Act, as the matter is settled outside the Court and they entered into compromise and filed joint memo along with this petition.
Complainant and the petitioner Nos.1 to 6 and 8/accused Nos.1 to 6 and 8 are also present and they are identified by their counsel and Public Prosecutor, produced Photostat copies of aadhar cards in proof of their identity. When terms of compromise are explained in Urdu language by Public Prosecutor for the State of Telangana, they are admitted to be true and correct. In view of the close relationship between the parties and as the offence committed by the petitioner Nos.1 to 6 and 8/accused Nos.1 to 6 and 8 is not against the society, permission is granted to compound the offence. Hence, compromise is recorded in terms of the joint memo filed along with the petition. Accordingly, the petitions are ordered in respect of petitioner Nos.1 to 6 and
MSM,J Crl.P_10405_2017 8/accusd Nos.1 to 6 and 8 while negating to record compromise in respect of petitioner Nos.7 and 9/accused Nos.7 and 9 as they are not present before this Court.
Crl.P.No.10405 Of 2017 In view of the orders passed in Crl.P.M.P.Nos.11565 and 11566 of 2017, the present petition is allowed-in-part in respect of petitioner Nos.1 to 6 and 8/accused Nos.1 to 6 and 8 in terms of the joint compromise memo filed by both parties while dismissing the petition against petitioner Nos.7 and 9/accused Nos.7 and 9 as they are not present before this Court. No costs. Registry is directed to annex a copy of the joint memo filed by both parties, to this order.
Consequently, miscellaneous applications pending if any, shall stand dismissed.
