THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8335 OF 2016 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 is filed by the petitioner/A-6 seeking to grant bail in the event of his arrest in connection with Crime No.46 of 2014 on the file of Mudigubba Police Station, Ananthapur District, registered for the offences punishable under Sections 147, 148, 302 and 120(B) read with 149 I.P.C.

2. Heard and perused the material available on record.

3. Case of the prosecution is that due to previous disputes between the de facto complainant group and the accused group, on 14.3.2014, A-1 to A-6 armed with deadly weapons and attacked the deceased by name Munagala and indiscriminately hacked with hunting sickles and stabbed with knives and caused severe bleeding injuries due to which, the deceased died on the spot.

4. Learned Additional Public Prosecutor opposed the bail application.

5. The earlier bail application filed by the petitioner was dismissed on 29.4.2016. There is no substantial change of circumstances. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
