HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.22558 OF 2016 ORDER:

Heard.

2. Questioning the action of respondent Nos.3 and 4 in interfering with the petitioner's possession over the property in S.No.296/1 to an extent of Ac.1-48 cents situated at Indukuru Village, Devipatnam Mandal, East Godavari District, and in trying to demolish the petitioner's cattle shed without issuing any notice, the present writ petition is filed.

3. Learned Government Pleader, on instructions received from the respondent authorities, submits that the petitioner is not in possession of the property, in question.

4. Apparently, the pattadar passbooks and title deeds produced by the petitioner disclose that he is the absolute owner and possessor of the disputed property. If there are any inter se disputes between any third parties and the petitioner, the respondent authorities have no manner of right to interfere with the said disputes.

5. In that view of the matter, without expressing any opinion on merits with respect to the submission made on behalf of the learned government pleader, I deem it appropriate to dispose of the writ petition directing the respondent authorities not to interfere with the petitioner's possession and enjoyment of the property in question and not to demolish the cattle shed of

the petitioner.

Subject to the above, the writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition, shall stand closed. No order as to costs.
