ORAL ORDER:
Heard learned counsel for petitioners and learned standing counsel for respondents and with their consent the writ petition is taken up for disposal at the admission stage. 2.
Petitioners claim to be residents of Veluru Road, Bapulapadu village and mandal, Krishna district. Petitioners apprehend that there is proposal to shift 33 K.V.Remalle feeder and 11 KV line of S.N.Palem feeder from the existing location through the properties of petitioners, effecting their enjoyment of properties. According to learned counsel for petitioners, Smt S Vijayalakshmi/ 6th respondent made a request for shifting of overhead power lines passing through her property and assessment was made and sanction was accorded on 30.1.2014 and now efforts are being made to shift the power lines. According to learned counsel, said information was obtained under Right to Information Act and on obtaining such information, this writ petition is filed. 3.
From the reading of proceedings dated 20.1.2014 and 30.1.2014, it appears that individual property owner has requested for shifting of power lines and agreed to pay the expenses required for shifting. It cannot be said that request made by individual for shifting of power line is not valid. However, though orders were made in January, 2014, it appears so far no steps are taken to shift power supply line. Petitioners apprehend that there is a proposal to shift power lines going through their properties. That being so and since it appears, so far no steps are taken, petitioners are
granted liberty to make appropriate representation within two weeks from the date of receipt of copy of this order to respondents 2 to 5 explaining that if power lines are shifted and passing through their properties, it would be causing hardship and no such shifting can be taken up only to favour the 6th respondent. On receipt of such a representation, competent authority shall consider and take appropriate decision, if necessary, it may also place on notice 6th respondent at whose instance there is a proposal to shift the power line and take appropriate decision as warranted by law. If no representation is received within the time stipulated above, the competent authority is at liberty to proceed with its original decision.
