Petition filed under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to enlarge the Petitioner/Accused No.4 on bail who is in jail in connection with Crime No. 29 of 2017 of P.S. Sirpur-U, Adilabad District, presently KB Asifabad District on such terms and conditions and pass such other order of orders as this Court may deem fit and proper in the interest of justice. The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri S. Surender Reddy, Advocate for the Petitioners and the Addl. Public Prosecutor(TS) for the Sole Respondent-State, the Court made the following ORDER :- "This petition is filed under Section 439 Cr.P.C. to grant bail to the petitioner-A4 for the offences alleged under Sections 420 and 306 IPC. 2.

Heard learned counsel for the petitioner-A4, learned Additional Public Prosecutor representing the State and perused the record. 3.

The specific allegation against the petitioner-A4 is that he has taken Rs.40,000/- from the deceased, who is his real brother. When this amount was not paid and some other amounts were not paid by the other persons, the deceased committed suicide. The petitioner-A4 was remanded to judicial custody on 25.10.2017.

Having regard to the nature of allegations levelled against the petitioner-A4 and the investigation conducted so far, the petitioner-A4 can be granted bail.

In the result, the Criminal Petition is allowed and the petitioner-A4 is ordered to be released on bail, on petitioner-A4 executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each in a like sum to the satisfaction of Judl. Magistrate of I Class, Utnoor, Adilabad District. On release, the petitioner-A4 shall attend before the S.H.O. concerned on every Saturday and Sunday between 10.00 A.M. and 11.00 A.M. till filing of charge sheet."
