HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39951 OF 2018 ORDER:

The present writ petition came to be filed seeking a direction to the respondents 1 and 2, to take into consideration the M.R.C.C dated 12.10.2018, issued by the 3rd respondent, while processing the application dated 16.8.2016, submitted by the petitioner, for grant of quarry lease of "Barytes" over the land to an extent of 1.085 hectares situated at Sy.No.1055/1, Old Sy.No.1021/48 of Vemula Village and Mandal, Y.S.R. Kadapa District.

Though various grounds are raised, the learned counsel for the petitioner, would submit that by an interim order dated 13.11.2018, this Court directed the 2nd respondent to deal with the application made by the petitioner for renewal of the quarry lease by taking consideration the M.R.C.C, issued by the 3rd respondent in favour of the petitioner. Today, when the matter is taken up for hearing, the learned Government Pleader for Mines and Geology, would submit that the application of the petitioner may be directed to process, in accordance with the law.

Having regard to the above, the writ petition is disposed of directing the 2nd respondent to deal with the application dated 16.08.2016, made by the petitioner for grant of quarry lease over the subject land and pass appropriate orders, in accordance with law, as early as possible preferably within a period of three to five months from the date of receipt of copy of this order after giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
