O R D E R
The grievance of the petitioner-society is that the Revenue Divisional Officer, Malkajgiri Division, Medchal-Malkajgiri District, is not considering its representation dated 16.02.2017 for grant of an occupancy rights certificate in relation to the land admeasuring Ac.22.14 guntas in Survey No.844/1 of Malkajgiri Village and Mandal, Medchal-Malkajgiri District. It appears that the Revenue Divisional Officer called for a report from the Tahsildar, Malkajgiri Mandal, upon the petitioner-society's representation and the Tahsildar submitted his report as long back as on 01.06.2017. The complaint of the petitioner-society presently is that despite receipt of the said report, the Revenue Divisional Officer is not taking further steps.
It is not open to the revenue authority to keep an application of this nature pending when valuable property rights are at stake. The writ petition is accordingly disposed of directing the Revenue Divisional Officer, Malkagiri Division, Medchal-Malkajgiri District, to consider the petitioner-society's representation on its own merits and in the light of the report dated 01.06.2017 submitted by the Tahsildar, Malkajgiri Mandal, MedchalMalkajgiri District, and take appropriate action thereon expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
