HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 39883 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Mines & Geology and learned Government Pleader for Revenue. With their consent, the writ petition is disposed of at the admission stage.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondent Nos.2 to 4 on the representation dated 11.10.2018 and allowing respondent No.5 at the instance of respondent Nos.6 to 8 for excavation and quarrying of sand in the lands in R.S.No.225, 237, 238, 243 and 244 of Chinchinada village, Yelamanchili mandal, West Godavari District, as illegal and arbitrary. 3) Learned Government Pleader for Revenue would submit that if the representation is made by the petitioner and is still pending consideration and if the District Collector is otherwise authorized to deal with it, he may dealt with the representation, in accordance with law. 4) Having regard to the above, the writ petition is disposed of directing the District Collector - respondent No.2 to deal with the representation dated 11.10.2018, if he is otherwise entitled to, in accordance with law, as expeditiously as possible.
