The case of the petitioner is that he has succeeded in civil litigation against the unofficial respondents and sale deeds executed by unofficial respondents were set aside in the civil suits. Thereafter, the petitioner made an application on 15-02-2018, 23-03-2018 and 09-05-2018 along with Form VI-A application for mutation of subject property situated at Kotluru Village fields, Vallur Mandal, Kadapa District and grant pattadar passbooks and title deeds in his favour. As the same is not being disposed of, the present writ petition is filed. Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Revenue submits that in view of civil litigation pending between the parties, the said application is kept pending. Since the petitioner states that he succeeded in civil litigation and sale deeds executed by unofficial respondents were set aside, there is no bar for considering the application of the petitioner. More so, when there is no stay operating against the decree by which sale deeds executed by unofficial respondents were cancelled. When the applications are stated to be pending before the respondents, these aspects have to be considered by them while disposing of the applications. In view of the same, without expressing any opinion on merits, the competent authority is directed to dispose of the applications made by the petitioner in accordance with law
within a period of four weeks from the date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 05-12-2018 Nvl
