The high-handed action of the 4th respondent Tahsildar, Vinjamur Mandal in attempting to dispossess the petitioner from the patta land in an extent of Ac.0.29 cents in Survey No. 563/1 (old Survey No. 57-2), Vinjamuru Village & Mandal, S.P.S.R.Nellore District, without following the due process of law, has been challenged in this Writ Petition.
In view of the order, which is proposed to be passed now, issuance of notice to the respondents has been dispensed with.
Heard learned counsel for the petitioner and learned Government Pleader for Revenue (Andhra Pradesh).
The material annexed to the Writ Petition, in particular the report dated 21.02.2015 of the Mandal Deputy Surveyor, Vinjamuru and the copy of the fair Adangal relating to Survey No. 57-2 made available to the petitioner under the Right to Information Act by the district revenue officials through proceedings, dated 06.09.2014, prima facie, would show the possession of the petitioner and her predecessor over the subject land.
In that view of the matter and in view of the allegations made by the petitioner in the affidavit filed in support of the Writ Petition, there shall be a direction to the respondents not to interfere with the peaceful possession and enjoyment of the petitioner over the subject property, without following the due process of law. With this, the Writ Petition stands allowed. No costs. Consequently, the Miscellaneous Applications, if any shall stand disposed of. _____________________________ CHALLA KODANDA RAM, J.
