HONOURABLE SRI JUSTICE P. NAVEEN RAO CONTEMPT CASE No. 637 of 2014 ORAL ORDER:

Petitioner alleges that direction issued by this Court in WPMP NO.

45375 of 2013 in W P No. 36497 of 2013 dated 26.12.2013 is not complied with.

Along with the counter affidavit, proceedings of the Superintending Engineer dated 19.3.2014 are enclosed, which discloses that against the decision of the Division Bench of this Court, appeals in SLP (CC) No. 79388046/2013 are pending before the Supreme Court and by order dated 16.4.2013 Supreme Court directed to maintain status quo on operation of the common order dated 14.3.2012. Informing the same, it is stated in para 8 of the said proceedings that since there is an order of status quo, the claim of the petitioner cannot be examined at this stage and appropriate action would be taken as per the outcome of the appeals pending before the Supreme Court.

Having regard to the order of status quo granted by Supreme Court on review of selections made, no review can be directed to be undertaken at this stage insofar as petitioner is concerned and in view of the categorical undertaking given by the respondents that they would consider the case of the petitioner with reference to number of days which he claimed to have worked, it cannot be said that the respondents have deliberately and willfully violated the orders of this Court, warranting initiation of proceedings under Contempt of Courts Act.

Taking note of the undertaking given by respondent in para 8 of the counter affidavit, the contempt case is closed. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed. ______________ P NAVEEN RAO,J DATE:19.1.2016 TVK
