Shaik Rasool, S/o. Latheef Petitioner (Accused No.1 in Cr.No.34/2017 of Nagaram P.S., Suryapet Dist) AND The State of Telangana, rep. by its Public Prosecutor, High Court of Andhra Pradesh, Hyderabad.
Respondent Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to grant Regular Bail to the petitioner in connection with Crime No. 34 of 2017 on the file of Nagaram Police Station, Suryapet District in the interests of justice. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri S.Viplava Simha Reddy, Advocate for the Petitioner and of the Addl. Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:
" Heard learned counsel for the petitioner/A.1 and learned Additional Public Prosecutor for the respondent State, and perused the record. This petition is filed under Section 439 Cr.P.C. for grant of bail to the petitioner/A.1 in Crime No. 34 of 2017 of Nagaram Police Station, Suryapet District, for the offences punishable under Sections 498-A, 307, 420, 354(D), 323 and 509 IPC.
The material on record reveals that the de facto complainant is none other than the wife of the petitioner/A.1. There were matrimonial disputes between them and she is living separately from the petitioner/A.1. It is alleged that on 09.02.2017, the petitioner/A.1 took kerosene in a can and made an attempt to burn the house of the de facto complainant. She made hue and cry. Then, the petitioner/A.1 ran away.
Having regard to the nature of allegations and as the petitioner/A.1 is in judicial custody from 22.09.2017, the petitioner/A.1 can be enlarged on bail on some conditions.
In the result, the petitioner/A.1 is ordered to be released on bail on his executing a personal bond of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate, Thungathurthy. On such release, the petitioner/A.1 shall attend before the Station House Officer, Nagaram Police Station, on every Sunday between 9.00 and 10.00 a.m. till filing charge sheet.
