THE HON'BLE SRI JUSTI CE A.V.SESHA SAI C.C.No.933 of 2016 ORDER:

This is an application under Sections 10 to 12 of the Contempt of Courts Act, 1971 alleging willful disobedience of the order of this Court dated 12.04.2016 passed in W.P.No.11906 of 2016. 2.

Petitioner herein filed W.P.No.11906 of 2016 assailing the show-cause notice bearing No.01/644(1)/20015 MDLC, dated 21.03.2016, issued by the Depot Manager, T.S.R.T.C, Medchal Depot, Ranga Reddy District, basing on the preliminary enquiry report submitted by the Assistant Manager (T) Enquiries, DVM's Officer/SNG, Kukatpally, Hyderabad 3.

This Court, on 12.04.2016, dismissed the writ petition, while keeping it open for the petitioner herein to submit explanation to the said show-cause notice dated 21.03.2016 within a period of one week from the date of receipt of a copy of the said order and with a further direction to the respondents to consider the same and take appropriate further action, in accordance with law. Alleging willful disobedience of the said order, the present Contempt Case is filed.

In the counter affidavit filed by the Depot Manager, TSRTC, Medchal Depot, Medchal, Hyderabd, it is stated that the respondent received a copy of the order dated 12.04.2016 on 26.04.2016 and as there was no explanation submitted by the petitioner within the time stipulated and as the respondent was unaware about the filing of the writ petition before the Court and the order dated 12.04.2016, passed the order of removal on 12.04.2016 and the same was sent to the petitioner through registered post on 12.04.2016 at 12.06 hrs.

During the course of hearing, it is submitted by the petitioner who is appearing as party-in-person that the petitioner herein filed appeal on 24.06.2016 before the Divisional Manager, TSRTC, Sanathnagar Division through Depot Manager and a copy of the same is also given to the learned Standing Counsel.

In view of these developments, this Court deems it appropriate to dispose of the present Contempt Case, with a direction to the Divisional Manager, TSRTC, Sanathnagar Division to consider the said appeal said to have been filed by the petitioner on 22.06.2016 and pass appropriate orders within four weeks from the date of receipt of this order, after giving notice and opportunity to the petitioner herein. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
