O R D E R

Heard the learned counsel for the petitioner and the leaned Government Pleader for Revenue for the official respondents.

As per the writ averments, the petitioner is claiming right over the land in an extent of Ac.0-62 cents in S.No.51/6, Ac.0-10 cents in S.No.51/7 and Ac.0-66 cents in S.No.52/8 situated at Maddilapalem village, Visakhapatnam District, based on an award passed by the Lok Adalat, Ramachandrapuram dated 26.11.2014 in O.S.No.706/2014. When the subject land was claimed by one Lokanadha Rao and respondents 8 and 9 herein, he filed suit in O.S.No.797/2014 on the file of VII Additional District Judge, Visakhapatnam, for declaration of title and injunction. Apprehending that the respondents 8 and 9 are making efforts for change of entries in revenue records, he made a representation to the 2n d respondent - District Collector, Visakhapatnam and other official respondents who are revenue authorities, to enquire into the matter.

On the said representation, the 2nd respondent - District Collector issued proceedings in CC.No.267/1976/B1 dated 7.1.2016, by way of endorsement, stating that the subject lands are non-surplus lands and not Government lands. Further, the Tahsildar and Sub-Registrar concerned, were directed to update their records and the 'E' Section in Collectorate office dealing with notification of the Government lands under Section 22-A of the Registration Act, was directed to update the records. Against this proceeding, the petitioner filed the present writ petition.

3. It is un-understandable as to how the petitioner is aggrieved by the impugned proceedings. By this proceeding, no right of the petitioner is violated. It merely states that the subject lands are not surplus lands and not Government lands. The petitioner already filed suit against the unofficial respondents. In view of these facts and circumstances, I do not find any merit in the writ petition and the same is dismissed at the stage of admission. No costs.
