Petition filed under Section 438 of Cr.P.C. praying that in the circumstances stated in the petition and grounds thereof, the High Court may be pleased to order enlarge the Petitioner on bail, in the event of his arrest in connection with C.O.R.No. 198 of 2016 dated 03.09.2016 on the file of SHO, Prohibition & Excise, Gadwal The petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri N. Sreedhar Reddy, Advocate for the Petitioner and the Addl. Public Prosecutor(TS) for the Respondent-State, the Court made the following ORDER :- "This petition is filed under Section 438 Cr.P.C. to grant anticipatory bail to the petitioner-A2 for the offence alleged under Section 34 (a) of Excise Act. 2.

Heard learned counsel for the petitioner-A2, learned Additional Public Prosecutor representing the State and perused the record. 3.

It is on record that the petitioner-A2 made a complaint against A1 for selling the toddy without licence. The petitioner-A2 has a licence to sell the toddy at the subject place. At the instance of A1, the petitioner-A2 is made an accused in this case.

Having regard to the nature of allegations and submissions made by both sides, the petitioner-A2 can be granted bail under Section 438 Cr.P.C. 5.

In the result, the Criminal Petition is allowed directing the petitionerA2 to surrender before the Station House Officer, Prohibition & Excise Police Station, Gadwal, within 15 days from the date of this order. On such surrender, the said S.H.O. shall release the petitioner-A2 on bail, on petitionerA2 executing a personal bond for Rs.10,000/- (Rupees ten thousand only) with two sureties each in a like sum to his satisfaction. On release, the petitionerA2 shall abide by the conditions mentioned under Section 438 (2) Cr.P.C. The petitioner-A2 shall attend before the S.H.O., Prohibiton & Excise Police Station, on every second Saturday between 10.00 A.M. and 11.00 A.M. till filing of charge sheet."
