This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ accused Nos.1 and 2, for grant of anticipatory bail in the event of their arrest in Crime No.9188 of 2017 on the file of the Vigilance & APTS Police Station, Adilabad, registered for the offence punishable under Section 135 of the Electricity Act, 2003.

Heard the learned counsel for the petitioners/ accused Nos.1 and 2, learned Additional Public Prosecutor representing the respondent-State and perused the record.

The case against the petitioners/ accused Nos.1 and 2 is that on 05.10.2017, at 07: 00 hours, the de-facto complainant/ A.E. lodged a report stating that he inspected the electrical meter box of petitioners/ accused Nos.1 and 2 and found that seal Bit No.1785490 was tampered slightly, melted, a hole on the seal and it was enlarged. It was also found that one MRP Plastic Bit No.002007167 available for meter cover also tampered and the seal was freely moving in the enlarged hole. Further, in single core greed white coloured PVC Copper wire is found extended to 1st floor. The electricity authorities estimated the loss to the company at Rs.21,549/ -. It is brought to the notice of this Court by the learned Additional Public Prosecutor that the offence punishable under Section 135 of the Electricity Act, 2003 is compoundable. The learned counsel for the petitioners/ accused Nos.1 and 2
` submitted that petitioners/ accused Nos.1 and 2 are ready to pay the compounding fee and get the offence compounded. The same is permissible under law. Under these circumstances, the petitioners/ accused Nos.1 and 2 are permitted to compound the offence as per law. In the event of such compounding of the offence, it is needless to state that all the criminal proceedings against the petitioners/ accused Nos.1 and 2 in Crime No.9188 of 2017 on the file of the Vigilance & APTS Police Station, Adilabad, would be closed in terms of law applicable.

With the above observations, this Criminal Petition is disposed of.
Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
